HOA Rules

Each Owner of a unit shall be responsible for ensuring that the Owner's Family, Guests, Tenants and Occupants comply with all provisions of the Condominium Declaration and Bylaws of the Association. Furthermore, each Owner and Occupant shall always endeavor to observe and promote the cooperative purposes for which the Association was established. In addition to any rights the Association may have against the Occupants of a unit as result of such persons violation of Condominium Declaration and Bylaws, the Association may take action against the Owner as if the Owner committed the violation in conjunction with the Owners Family, Guests, Tenants, and Occupants.

1) Decks: No objects other than potted plants, patio furniture, and Electric grills are allowed on decks. All other items are not allowed which include but not limited to trash bags, bicycles, gas and charcoal grills, coolers, storage boxes, exercise equipment, etc. are not allowed. Patios can not be enclosed. No drapes, blinds, screens, or covers may be hung above or behind the rail for any reason. Potted plants are the only items that may be hung above the rails or placed on the rails securely. Patio lights may be placed inside the rails or along the ceiling as long as they don't protrude outside of the patio rail.

2) No garbage or trash shall be placed on Common grounds, temporarily or otherwise. Trash can NOT be set in breezeways or on decks temporarily. No items of any kind including but not limited to furniture, boxes, or any unwanted item shall be placed on the ground near dumpster and recycle bins. Cameras are in place to catch and fine any violators up to $200.

3) Items to recycle are limited to Aluminum cans, Plastic bottles and containers that display the *recycle* symbol, and news or printer paper. All other items including cardboard, glass, and Styrofoam shall be thrown in dumpster.

4) All pets must be kept on a leash and under physical control of a responsible person at all times when outside of owners unit. Feces left by pets must be removed immediately. City of Smyrna has leash law in addition to the HOA. No pets may be left unattended on common grounds or on patios.  *Register Your Vehicle and Pets Form*

5) Occupants shall keep no more than 2 pets including dogs and/or cats for a combined total of 2 per Unit. No snakes, potbellied pigs, American Pit Bull Terriers, Rottweilers, or Doberman Pinschers may be brought onto or kept at the Condominiums at any time.

6) No parking of trailers or Commercial trucks including moving trucks on property overnight.

7) Disabled and Stored Vehicles are prohibited from being parked at the Condominiums. Vehicle is considered disabled if it has an expired tag or if it's obviously inoperable. A vehicle is considered stored if it remains in same spot without being driven for 14 days or longer. If you travel out of town you can notify HOA the dates your vehicle will be stored so it's not towed.

8) No signs shall be posted on common grounds or in windows including but not limited to 'For Sale' and Political signs. Stickers for Security systems no larger than 6" are allowed on windows and doors.

9) Satellite Dishes or Antennas are not allowed on Common grounds or roofs. They are allowed to be placed on patios as long as they're on a tripod or temporarily mounted on the "inside" of deck railing only. No wiring can be attached to the outside walls.

10) Each Unit shall be used for Residential Purposes Only. 

11) The Maximum number of Occupants is limited to two (2) people per bedroom. 


12) An Occupant shall not conduct activities within a unit or use a unit in a manner that interferes with or causes disruption to the use and quiet enjoyment of another unit by its respective Owner or Occupant.

13)  The display or discharge of firearms or fireworks on Common Elements or Limited Common Elements is prohibited. 

14) All units must be heated to a minimum of 55 degrees Fahrenheit to prevent pipes from freeing and bursting in cold months.

15) All Window treatments in a unit must have 2” wood blind window treatments that are White and White only.

16)  Do NOT store any personal items on Common ground which includes but not limited to breezeways.


17) Replacing Carpeted flooring:  No unit shall have carpet replaced with Tile or Wood flooring without prior written consent of the HOA Board. 


18) Holiday Lights: Holiday lights may only be displayed from Thanksgiving to January 15th and not placed on Common ground.


LEASING YOUR UNIT: In order to preserve the character of the Condominiums as predominantly owner occupied and to comply with eligibility requirements for FHA financing the leasing of units shall be prohibited except as listed below. "Leasing" is defined as regular exclusive occupancy by any person other than the Owner.

1) Owners must make a request to the Board to lease their unit and receive approval.  Only a total of 26 units can be leased at any given time. There is a waiting list and any unauthorized leasing can result in a fine of $25 per day.

2) Owners, if approved must lease their unit for no less than one year. Copy of Leasing contract must be provided to the Board.

3)  Owners can not publish their unit on AirBNB or any similar site.

4) Tenants must be informed of all of the rules associated with living at the Madison. Any violations are fined against the Owner.

6) Tenants must also be present for the annual fire sprinkler inspection.
